Terms of Service

These Terms of Service ("Terms") govern your access to and use of the EVLONGHAUL website and trip-planning service at evlonghaul.com (the "Service"), operated by EVLONGHAUL LLC, a Kentucky limited liability company with a mailing address of PO Box 22171, Louisville, KY 40252-0171 ("EVLONGHAUL," "we," "us," or "our"). You accept these Terms by selecting "Plan my drive" (the planner states this next to the button), or by otherwise using the Service. If you do not agree to these Terms, do not use the Service.

1. The Service

EVLONGHAUL is a free planning tool (which may be supported by clearly disclosed affiliate links and, potentially in the future, advertising) that produces estimated electric-vehicle road-trip itineraries for the continental United States, including suggested driving routes, suggested charging stops, and estimated charging times, based on public data sources and simplified mathematical models. The Service is provided for general informational and planning purposes only.

2. Eligibility and Age

You must be at least 18 years old (or the age of majority where you live) to accept these Terms. A person aged 13 to 17 may use the Service only if a parent or legal guardian accepts these Terms on their behalf and supervises their use. The Service is not directed to, and may not be used by, children under 13.

3. Estimates Only: Not Navigation, Not Advice

Every output of the Service (including routes, distances, drive times, energy consumption, vehicle range, battery capacity, charger locations, charger availability, charger power, and charging durations) is an estimate that may be inaccurate, incomplete, or out of date. Real-world electric vehicle range varies substantially with temperature, weather, speed, terrain, payload, battery age, and vehicle condition. Charging stations may be closed, occupied, broken, relocated, removed, restricted, or slower than listed. The Service is not a navigation system, does not provide real-time information, and is not a substitute for your own judgment, your vehicle's onboard systems, or official charging-network apps.

Before and during any trip, you must independently verify your route, your vehicle's actual range and state of charge, and the existence, availability, compatibility, and operational status of every charging stop you intend to rely on.

Do not interact with the Service while driving. Plan before you depart, and pull over safely before re-checking your plan. The Service is not designed for use in emergencies. If you are in danger or stranded, contact emergency services or roadside assistance, not this website.

4. Assumption of Risk

You acknowledge that long-distance travel involves inherent risks, including the risk of a depleted battery away from charging infrastructure. You assume all risks arising from your use of or reliance on the Service, including stranding, delay, towing, missed events, and any resulting personal or financial harm. You are solely responsible for safe vehicle operation and for compliance with all traffic laws.

5. Third-Party Data and Services

The Service displays and relies on data and services from third parties: map, geocoding, and routing providers, charging-station databases (including the U.S. DOE/NREL Alternative Fuels Data Center and Open Charge Map, used under CC BY 4.0), and vehicle data from the U.S. EPA (fueleconomy.gov). The current list of providers is maintained on our Data & attribution page, and we may add, remove, or change data and service providers at any time. We do not control, verify, or guarantee third-party data, and its appearance in the Service is not an endorsement of any charging network, business, or location. Third-party services have their own terms and privacy policies.

6. No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, OR UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT THE SERVICE OR ANY OF ITS OUTPUTS WILL BE ACCURATE, RELIABLE, COMPLETE, OR ERROR-FREE, OR THAT THE SERVICE WILL BE AVAILABLE AT ANY PARTICULAR TIME.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVLONGHAUL AND ITS OWNER, OPERATORS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF TIME, PROFITS, DATA, OR GOODWILL, OR FOR VEHICLE DAMAGE, BATTERY DEPLETION, STRANDING, TOWING OR RECOVERY COSTS, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND REGARDLESS OF THE THEORY OF LIABILITY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US TO USE THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM (WHICH, FOR THIS FREE SERVICE, IS ZERO) OR TEN U.S. DOLLARS (US $10).

Nothing in these Terms excludes or limits any liability for fraud, willful misconduct, or gross negligence, or any other liability that cannot lawfully be excluded or limited. Some jurisdictions do not allow certain limitations; in those jurisdictions, the limitations above apply only to the fullest extent permitted by law.

8. Indemnification

You agree to defend, indemnify, and hold harmless EVLONGHAUL and its owner and operators from third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) to the extent caused by: (a) your intentional unlawful conduct in connection with the Service; (b) your infringement of a third party's intellectual-property or other rights; or (c) your material breach of these Terms. This obligation does not apply to the extent a claim is caused by EVLONGHAUL's own acts or omissions.

9. Acceptable Use

You agree not to: (a) access the Service by automated means (bots, scrapers, bulk requests) or exceed reasonable personal use; (b) interfere with or disrupt the Service or circumvent its rate limits or security measures; (c) resell, redistribute, or frame the Service or its outputs as your own product; (d) use the Service for any unlawful purpose. We may throttle, suspend, or terminate access at our sole discretion, with or without notice.

10. Intellectual Property; Your Itineraries

The Service's software, design, text, and branding are owned by EVLONGHAUL or its licensors and are protected by law. Third-party data remains the property of its respective providers and is subject to their licenses (see our Data & attribution page). You receive a limited, revocable, non-exclusive, non-transferable license to use the Service for personal, non-commercial trip planning. Within that license, you are expressly welcome to save, print, screenshot, and share the trip plans you create for your own travel and with your travel companions.

11. Affiliate Links and Advertising

The Service may include affiliate links (for example, to charging adapters or accessories). Where we recommend a product through an affiliate link, that is a genuine recommendation, and we may earn a commission on qualifying purchases at no additional cost to you. We disclose this alongside the recommendation itself, not only here. We are not responsible for third-party products or merchant sites, and the merchant's terms govern any purchase. If third-party advertising is introduced in the future, advertisements will be third-party content and will not represent our endorsement of the advertiser; we will update these Terms and the Privacy Policy before any advertising goes live.

12. Changes to the Service or Terms

We may modify, suspend, or discontinue the Service (or any part of it) at any time. We may revise these Terms from time to time; the "Last updated" date above reflects the current version. Revisions apply prospectively only: a revised version governs your use of the Service after it is posted and does not apply retroactively to any dispute that arose before it was posted, and no future revision will impose a new dispute-resolution or liability provision on a pre-existing dispute. We will give conspicuous notice on this site of material changes. Your continued use of the Service after a revision takes effect constitutes acceptance of the revised Terms.

13. Governing Law and Venue

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state courts located in Jefferson County, Kentucky, or the United States District Court for the Western District of Kentucky, and you consent to the jurisdiction of those courts. Either party may instead bring an individual claim in small-claims court where jurisdiction permits.

14. Severability; Entire Agreement

If any provision of these Terms is held unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions will remain in full force. These Terms are the entire agreement between you and EVLONGHAUL regarding the Service. Our Privacy Policy describes our data practices for your information and acknowledgment; it is not incorporated into these Terms as a contractual promise.
